Can I continue my my mortgage holder for mental distress?
They are foreclosing on my condo and gave me a sheriff's sale official date in February 2009. When I received notice of this, I moved. However, after Obama was elected and they trying to reduce the number of seizures, my lender has imposed a moratorium on foreclosures. Well, it's a year and a half later, still no sheriff's sale and my condo association is now suing me for back dues to associations that I have not paid since February 2009 (the date my lender I given for the sale of the property). Can I sue my lender for mental anguish, because they will not exclude? This weighs heavily on my mind every day, and raises my blood pressure started to affect my sleep.
Not successfully. This is a case of contracts. You do not get emotional distress damages in a case of contracts.
